Andrej Babiš, the self-styled billionaire that secured victory in last month's Czech election, has refused to sell his vast corporate assets, while asserting he will address a conflict of interest that might block him from assuming the position of prime minister.

Stance on Corporate Empire

Babiš, whose political movement emerged victorious in the October election but lacked a majority in parliament, declared in a social media post that he would not sell his Agrofert conglomerate, which is active in farming, food production, and chemical industries.

“I have repeatedly said I will not sell Agrofert. I have repeatedly stated I will address the conflict of interest in compliance with national and EU regulations,” Babiš remarked. “This is not like selling a pastry in a bakeshop.”

President's Demand

The head of state, Petr Pavel, stated that the 71-year-old political figure must publicly explain how he will remove conflicts of interest arising from his business activities before being appointed premier.

The national charter “clearly mandates the president to consider the possible emergence of a conflict of interest and the possibilities for its resolution” when selecting government ministers, Pavel's office noted.

The head of state “expects clarity in what specific way Andrej Babiš will meet his constitutional and legal obligations”, the statement added, stating that Pavel was prepared to designate Babiš as premier “without delay” once the matter was resolved.

Business Operations and Regulatory Concerns

Babiš's numerous companies, primarily under the Agrofert group, function in the Czech Republic and other central European countries, receiving millions of euros in national and EU agricultural and other subsidies, as well as public contracts.

Under national legislation, government ministers are barred from receiving public aid or contracts. The anti-corruption watchdog Transparency International has stated that to prevent a conflict of interest, Babiš must either divest, refuse government deals, or stay out of public office.

Past Term and Present Intentions

Babiš said he would “follow the laws” if appointed as premier, but did not want to explain how in beforehand because the matter was “an highly personal and private affair for me, and the media will always question me anyway”.

During his initial tenure as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an European inquiry over possible ethical issues. He temporarily moved his holdings into fiduciary arrangements, while keeping some influence over them.

A court and the European Commission both determined that this was insufficient. Babiš stated recently that he was again the exclusive proprietor of Agrofert and insisted he was “implementing measures” to avoid a ethical problem, but refused to reveal specifics.

Coalition Agreement and International Implications

The wealthy politician has signed a coalition agreement with two minor right-leaning groups, the ultra-conservative, pro-Russian SPD, which has called for a referendum on exiting the EU, and the Motorists for Themselves, which has primarily opposed the EU’s Green Deal.

The incoming administration, if approved, is likely to bolster the populist movement in central and eastern Europe and might strain backing from Western nations for Ukraine – even though Babiš has called Ukraine’s leader, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as president has a role for foreign policy, also requested that the government agenda include a statement on the official stance on the conflict in Ukraine, including a pledge to meeting alliance duties.

The head of state has earlier stated he would not endorse any cabinet candidates who might question the nation's international alliances, a requirement that the far-right SPD has said it will satisfy by proposing non-partisan experts.
